13.2 Arbitration

If the Dispute cannot be resolved through negotiation, it shall be finally settled by arbitration administered by the Istanbul Arbitration Centre (ISTAC) in accordance with its Arbitration Rules in force at the time of the arbitration. The seat of arbitration shall be Istanbul, Türkiye; the language shall be English; and there shall be one (1) arbitrator, unless the parties agree otherwise or ISTAC determines that three (3) arbitrators are appropriate. The arbitral award shall be final and binding on the parties.

13.3 Waiver of Class Actions

YOU AND FUTURA TOPTAN AKARYAKIT DAĞITIM VE TİCARET LİMİTED ŞİRKETİ AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
